On Assisting the Electoral Commissions in Arrangements for Preparing and Holding the Elections of Deputies to the State Duma of the Federal Assembly of the Russian Federation

RESOLUTION OF THE GOVERNMENT OF THE RUSSIAN FEDERATION

In order to assist the electoral commissions in making arrangements for preparing and holding the election of deputies to the State Duma of the Federal Assembly of the Russian Federation and in accordance with Federal Laws «On Basic Guarantees of Electoral Rights and the Right of Citizens of the Russian Federation to Participate in a Referendum» and «On Election of Deputies of the State Duma of the Federal Assembly of the Russian Federation», the Government of the Russian Federation hereby resolves:

1. The Ministry of Finance of the Russian Federation shall, within the times established by the legislation of the Russian Federation, make available to the Central Election Commission of the Russian Federation the funds allocated by the Federal Law «On the 1999Federal Budget» for preparing and holding the election of deputies to the State Duma of the Federal Assembly of the Russian Federation.

2. The Central Bank of the Russian Federation is advised to ensure timely opening of electoral commission accounts, and Savings Bank of the Russian Federation shell be advised to timely open the accounts of any candidates, registered candidates, electoral associations, electoral blocs, and electoral commissions, including electoral deposit accounts, in accordance with the established procedure.

3. The Ministry of Interior of the Russian Federation, the Ministry of the Russian Federation for Civil Defense, Emergencies, and Control of Natural Calamities, the Ministry of Foreign Affairs of the Russian Federation, the Ministry of Defense of the Russian Federation, the Ministry of Transportation of the Russian Federation, the Ministry of Justice of the Russian Federation, the State Committee of the Russian Federation for Fisheries, the Federal Military Railway Service of the Russian Federation, the Federal Migration Service of Russia, the Federal Service of Russia for Hydrometeorology and Environmental Monitoring, the Federal Security Service of the Russian Federation, the Federal Border Service of the Russian Federation, and the Federal Agency for Government Communications and Information under the President of the Russian Federation shall assure:
a) In the procedure and within the times established by Paragraphs 4,6 and 7, Article 15 of the Federal Law «On Election of Deputies of the State Duma of the Federal Assembly of the Russian Federation», submission of information for compilation of the voter lists;
b) In the procedure and within the times established by Paragraphs 5,6 and 8 of Article 14, Paragraphs 9 and 10 of Article 21 of the Federal Law «On Election of Deputies of the State Duma of the Federal Assembly of the Russian Federation», establishment of electoral districts, setting up of the district electoral commissions, and delivery of the protocols evidencing the results of voting to the appropriate territorial electoral commissions.

4. On or before October 1, 1999, the Ministry of Interior of the Russian Federation, the Ministry of the Russian Federation for Civil Defense, Emergencies, and Control of Natural Calamities, the Ministry of Defense of the Russian Federation, the Ministry of Justice of the Russian Federation, the Federal Military Railway Service of the Russian Federation, the Federal Security Service of the Russian Federation, the Federal Border Service of the Russian Federation, and the Federal Agency for Government Communications and Information under the President of the Russian Federation shall take appropriate measures to assure the electoral rights of any citizens serving in the respective agency, and any citizens residing on the premises of any military bases.

5. The Ministry of Interior of the Russian Federation, jointly with other law enforcement authorities, shall assure:
a) Free of charge, maintenance of public order and public security during the period of preparing and holding the elections of deputies to the State Duma of the Federal assembly of the Russian Federation, including provision of security to electoral commission premises and voting premises, escort and protection of any vehicles carrying electoral documents, fire safety of electoral commission premises and voting premises;
b) At request of any electoral commission, provision of information whether any candidate or registered candidate running for deputies has any outstanding or non-expunged criminal record, including any conviction under criminal law of any foreign state for any act considered criminal under the Criminal Code of the Russian Federation, within 10 day of receiving such inquiry. In case such inquiry is received within 10 days to the voting day (including the ballot day), such information shall be provided forthwith.

6. The Ministry of Foreign Affairs of the Russian Federation shall assure that responses to any inquires of electoral commissions whether any candidate and any registered candidate running for deputy has a foreign nationality are provided within 10 days. In case such inquiry is received within 10 days to the voting day (including the ballot day), such inquiry shall be processed by any due day established by the electoral commission.

7. The Ministry of Interior of the Russian Federation, the Ministry of Justice of the Russian Federation, and the Ministry of Defense of the Russian Federation shall assist the electoral commissions in assuring the electoral rights of any citizens of the Russian Federation in the course of voting by suspects or defendants held in custody.

8. The Ministry of Interior of the Russian Federation and the Federal Security Service of the Russian Federation shall take due measures to stop any unlawful campaign activity, to immediately advise the electoral commissions of any identified facts of such unlawful campaign activity and any measures taken in accordance with the legislation of the Russian Federation.

9. The Russian Federal Service of Air Transport and its territorial agencies shall assist the electoral commissions in agreeing on the costs of air transportation when negotiating contracts with any organizations that provide such commissions with air transportation services in order to hold voting in remote and inaccessible locations and at polar stations.

10. The State Committee of the Russian Federation for Telecommunications shall take due measures to provide the electoral commissions with necessary communication services and to operate the National Automated System «Vybory» (Election) of the Russian Federation on the basis of contracts with telecom operators and in accordance with any rates established for the entities funded from the federal budget.

11. The State Paramilitary Courier Service of the Government of the Russian Federation and the State Committee of the Russian Federation for Telecommunications, jointly with the Central Election Commission of the Russian Federation shall assure prompt delivery of any electoral documentation of the Central Election Commission of the Russian Federation, electoral commissions of any Subjects of the Russian Federation, circuit, territorial, and district electoral commissions, and also provision of paramilitary courier and special communication services to electoral commissions at any rates established for federal bodies of government and their territorial agencies.

12. The Ministry of Railways of the Russian Federation, the Ministry of Transportation of the Russian Federation, and the Russian Federal Service of Air Transport shall assure priority delivery to the electoral commissions of any election-related cargoes.

13. The Ministry of the Russian Federation for Press, Broadcasting and Mass Media:
a) Shall provide to the Central Election Commission of the Russian Federation and shall procure that its territorial agencies provide the respective electoral commissions of the Subject of the Russian Federation with the lists of any entities subject to operation of respectively Paragraphs 2 and 3, Article 55 of the Federal Law «On Election of Deputies of the State Duma of the Federal Assembly of the Russian Federation»;
b) Procure due supervision over provision by any broadcasting organizations and editorial offices of any newspapers and periodicals, which are subject to the operation of Paragraph 1, Article 55 of the Federal Law «On Election of Deputies of the State Duma of the Federal Assembly of the Russian Federation», of free air time and print space to the electoral commissions, registered candidates, electoral associations, and electoral blocs, and over publication of any resolutions of electoral commissions, voting outcomes and election results in accordance with the legislation of the Russian Federation;
c) Shall procure that any broadcasters and editorial offices of newspapers and periodicals, regardless of their ownership structure, comply with the requirements of maintenance separate accounts with regard to the amount and costs of free and paid airtime and print space provided to any registered candidates, electoral associations, and electoral blocs, as well as submission of such accounts within due dates established by the legislation of the Russian Federation, with regard to any registered candidates in single-seat constituencies, to the electoral commission of the subject of the Russian Federation, and, with regard to any electoral associations, electoral blocs, and any candidates included into a registered federal list of candidates, to the Central Election Commission of the Russian Federation;
d) Shall take due measures established by the legislation of the Russian Federation with regard to any broadcasters and editorial offices of print media that violate the Federal Law «On Election of Deputies of the State Duma of the Federal Assembly of the Russian Federation»;
e) Shall assure due supervision over compliance by printing presses, regardless of their ownership structure, with the requirements of the Federal Law «On Election of Deputies of the State Duma of the Federal Assembly of the Russian Federation», in the course of producing any electoral documentation and printed campaign materials, applying any sanctions in accordance with the legislation of the Russian Federation;

14. f) Jointly with the Ministry of Economy of the Russian Federation, shall give its opinion whether any prices and rates applicable to production of printing materials for electoral commissions are reasonable.

15. The Ministry of Interior of the Russian Federation, the Ministry of the Russian Federation for Taxes and Levies, the Ministry of the Russian Federation for Press, Broadcasting, and Mass Media, the Ministry of Finance of the Russian Federation, the Ministry of Justice of the Russian Federation, the Federal Security Service of the Russian Federation, the Federal Tax Police Service of the Russian Federation, and their territorial agencies shall, as requested by the relevant electoral commission, second experts to work with their supervision and audit services under the Central Election Commission of the Russian Federation and under any electoral commissions of the Subjects of the Russian Federation for at least 6 months, and for at least 4 months to work for the supervisory and audit services of any district electoral commissions. The above federal executive agencies shall assist the electoral commissions in discharging their powers with regard to supervising the established procedure for funding the electoral campaigns of any candidates, registered candidates running for deputies, electoral associations and/or electoral blocs.

16. The Ministry of Justice of the Russian Federation, in accordance with the Federal Law «On Election of Deputies of the State Duma of the Federal Assembly of the Russian Federation», shall assure presentation to the respective electoral commissions, on their request, of information regarding any legal entities that make voluntary contributions to electoral funds, which are registered with the territorial agencies and offices of justice.

17. The Ministry of the Russian Federation for Taxes and Levels, jointly with the State Committee of the Russian Federation for Land Policy, shall assure, as requested by Electoral Commission, the verification of the following information:
a) Regarding the amounts and sources of income and property of any candidates and registered candidates running for deputies, advising the results of such checks to the electoral commissions within 10 days of receiving such inquiry. In case such inquiry is received within 10 days to the voting day (including the ballot day), the results of such checks shall be advised forthwith;
b) Regarding any details that the legal entities must indicate in accordance with the Federal Law «On Election of Deputies of the State Duma of the Federal Assembly of the Russian Federation», advising the results of such checks to the electoral commissions within 5 days of receiving such inquiry. In case such inquiry is received within 5 days to the voting day (including the ballot day), the results of such checks shall be advised forthwith.

18. The executive bodies of the Subjects of the Russian Federation, relevant officials and bodies of government shall be advised:
a) to assure that the electoral commission members (or any relevant part of them) are appointed in accordance with the legislation of the Russian Federation;
b) to provide, free of charge, voting premises, and any additional hardware as required for operation of the electoral commissions;
c) to provide the territorial electoral commissions with information on voters, to make available specially equipped locations for displaying printed campaign materials, as well as to procure the publication of any information related to establishment of electoral districts, allocate vehicles and communication means at any rate established for budgetary units, and to place any orders for production of ballots with printing presses, subject to payment for such services at any rates established for state-owned printing presses;
d) to assist the tax authorities in conducting audits in accordance with Paragraph 16 hereof.

19. To agree with the proposal of the Central Election Commission of the Russian Federation as regards the need for developing a package of measures for legal education of the voters and training election officials in charge of elections and referendum between 2000 and 2005, as well as the need for further development and operation of the National Automated System «Vybory» of the Russian Federation.

20. The federal executive bodies that assist the electoral commissions in making arrangements for preparing and holding the elections of deputies to the State Duma of the Federal Assembly of the Russian Federation shall implement the respective organizational and technical measures and, on or before September 1, 1999, shall set up task forces for prompt resolution of any issues related to the preparation or holding of the above elections.
