Article 44 - Rights and Responsibilities of a Registered Candidate
All registered candidates shall have equal rights and shall bear equal responsibilities.
After registration, a candidate shall, on the basis of a personal request, be relieved of his/her work, service, military training for a period lasting from the day of registration to the day of official publication of the election results. The administration of the enterprise, institution, organization, the commander of a military unit, the head of an interior ministry body where a registered candidate works, serves shall, upon the request (report) of the registered candidate, relieve him/her from his/her work, service on any day and for any time within the aforementioned period. During this period, a district election commission shall pay the candidate a compensation from the funds allocated for the preparation and conduct of the elections in the amount not exceeding ______ times the minimum wage established by federal law as of the day on which the elections were called.
In the period from the day of registration to the day of official publication of the election results a registered candidate shall not be fired by the administration (employer) and, without his/her consent, shall not be transferred to another job, including a job in another locality, appointed to another position or sent on a business trip. The time of participation of a candidate in elections shall be included in his/her service record in accordance with his/her specialty before the date of his/her registration as a candidate.
A registered candidate shall not be prosecuted, arrested or subjected to a court-imposed administrative punishment without the consent of the Procurator of the [Subject of the Russian Federation]. Upon giving such consent the Procurator shall immediately inform about this the district election commission which registered the candidate.
A candidate may withdraw his candidature not later than 3 days prior to voting day.
Electoral associations, electoral blocs may recall any candidate or candidates whom they nominated at any time but not later than three days prior to voting day. A decision to recall a candidate or candidates shall be taken by secret ballot by the body which nominated the candidate.
If a candidate has withdrawn his candidature or an electoral association, electoral bloc has recalled a candidate nominated in a single-mandate electoral district without any compelling reasons, the election commission of the [Subject of the Russian Federation] may require the candidate, electoral association, electoral bloc to compensate for a corresponding part of expenses incurred by election commissions, including the funds allocated to the candidate by a district election commission for election propaganda activities.
The registered candidate shall lose the rights conferred and be released from the responsibilities imposed on him/her by the status of a registered candidate after a district election commission officially announces the election outcome in the mass media. In the event of repeat voting, the registered candidates on whose candidatures repeat voting is not to be conducted shall lose their status from the day on which the election commission announces the date of repeat voting.
Article 45 – Candidate Travel
Upon registration a candidate shall be entitled to the free use of all kinds of public transport (with the exception of taxies and chartered trips) in the territory of the given single-mandate electoral district up to the day of official publications of general election results. In cities where there are several electoral districts a candidate may use the municipal public transport (with the exception of taxies and chartered trips) free of charge throughout the territory of the city.
Article 46 - Agents of Candidates
Each candidate registered in a single-mandate electoral district shall be entitled to appoint up to 10 agents who may carry on election propaganda and other activities in support of the candidate. Agents shall be promptly registered by a district election commission on the basis of a written application of a candidate and a written consent of the person to act as an agent. Upon registration candidates' agents shall receive certificates of an established form.
The administration (employer) shall grant agents, upon their request, an unpaid leave for the period from the registration date of the candidate to the date of official publication of the general election results.
Candidates may recall and replace agents at any time by serving a notice to this effect on the appropriate district election commission, which shall then cancel the certificate issued to the recalled agent and issue a certificate to the newly appointed agent.
The powers of agents shall terminate at the time the registered candidate who appointed them loses his/her status.
Article 47 - Provisions Ensuring Equal Status of Registered Candidates
Registered candidates who occupy state offices of the category «A» according to the federal law on the principles of the government service in the Russian Federation shall not take advantage of their official position.
Registered candidates on government or municipal service or working in the mass media shall be relieved of their official duties during the period of their participation in elections. They shall present to an election commission a certified copy of an appropriate order (directive) within three days after registration and shall not take advantage of their official position or status.
A registered candidate occupying a state office of category «A» may engage in election propaganda only when he/she is not performing his/her official duties (on holidays, weekends and other days-off). This rule shall not apply when a registered candidate is to use free air time on the channels of state and municipal TV and radio companies in accordance with this Law.
Registered candidates shall not use any monetary funds, equipment, structures, personnel or other material and technical facilities available to them by virtue of their official position in order to gain election.
Journalists, other persons engaged in creative pursuits as well as officials of editorial offices of the mass media, officials and creative workers of state TV and radio companies shall not participate in highlighting the election campaign through the mass media if these persons are candidates or agents of candidates.
A breach by a registered candidate of the provisions of this article shall be sufficient reason for a district election commission to withdraw registration of the candidate.
