Chapter I. General provisions
Article 1. Basic Principles of Participation of Citizens of the Russian Federation in Election of Deputies or the Legislative (Representative) Body of State Power of a Subjects of the Russian Federation
Deputies of the legislative (representative) body of state power of a legal subject of the Russian Federation shall be elected by citizens of the Russian Federation residing in the territory of the legal subject of the Russian Federation on the basis of universal, equal and direct suffrage by way of secret ballot. Participation in elections shall be on a voluntary basis.
Article 2. Legislation on Elections of Deputies of the Legislative (Representative) Body of State Power of a Legal Subject of the Russian Federation
Legislation on elections of deputies of the legislative (representative) body of state power of a legal subject of the Russian Federation is constituted by the Constitution of the Russian Federation, Charter (Constitution) of the legal subjects of the Russian Federation, the Federal Law «On Basic Guarantees of Electoral Rights of Citizens of the Russian Federation», other federal laws, this Law, other laws and other statutory acts of the legislative (representative) body of state power of a legal subject of the Russian Federation.
Article 3. Glossary (Basic Terms Used in This Law)
For the purposes of this Law the following terms are used:
Deputy means a deputy of the legislative (representative) body of state power of a legal subject of the Russian Federation;
Voter means a citizen of the Russian Federation who has reached the age of 18 and enjoys the right to elect deputies of the legislative (representative) body of state power of a legal subject of the Russian Federation;
Electoral association means a public associations that performs its activities within the boundaries of a legal subject of the Russian Federation, the Charter of which stipulates the participation in elections of bodies of state power by nominating candidates and that was established and registered with the bodies of justice of the legal subject of the Russian Federation in the procedure set by federal laws, laws and other statutory acts of the legislative (representative) body of state power of the legal subject of the Russian Federation or registered with a body of justice of the legal subject of the Russian Federation in the procedure set by federal laws, laws and other statutory acts of the legislative (representative) body of state power of the legal subject of the Russian Federation at least 6 months prior to the day of announcing the elections, a branch of an all-Russia or inter-regional public association the charter of which stipulates its participation in elections of bodies of state power by nominating candidates;
Electoral bloc means a voluntary union of two or more electoral associations;
Election commissions means election commissions that are in charge of preparation and administration of elections of deputies of the legislative (representative) body of state power of a legal subject of the Russian Federation;
Candidate means a candidate for deputy of the legislative (representative) body of state power of a legal subject of the Russian Federation.
Article 4. Electoral Rights of Citizens of the Russian Federation at Elections of Deputies of the Legislative (Representative) Body of State Power of a Legal subject of the Russian Federation
A citizen of the Russian Federation residing in the territory of the legal subject of the Russian Federation who has reached the age of 18 is entitled to elect deputies of the legislative (representative) body of state power of the legal subject of the Russian Federation.
A citizens of the Russian Federation who enjoys the right to elect deputies in compliance with clause 1 of this Article who has reached the age of 21 on election day and who has resided in the territory of the Russian Federation at least 1 year as of the date when the election of deputies of the legislative (representative) body of state power of the legal subject of the Russian Federation is set, may be elected a deputy of the legislative (representative) body of state power of the legal subject of the Russian Federation.
Citizens of the Russian Federation who found incapable by a court of law or imprisoned by a decision of a court of law is not entitled to elect or be elected.
Article 5. Setting of Elections
In compliance with the Charter (Constitution) of the legal subject of the Russian Federation elections of deputies of a new convocation shall be set by the head of the executive body of state power of the legal subject of the Russian Federation. Election day shall be the first Sunday after the expiration of the term of powers of the legislative (representative) body of state power of the legal subject of the Russian Federation i.e. the State Duma of the previous convocation. The term from the day of setting the elections till election day shall be at least for month.
In the event the head of the executive body of state power of a legal subject of the Russian Federation fails to set the election of deputies in the time term set by Clause 1 of this Article elections of deputies shall be held by the election commission of the legal subject of the Russian Federation on the first Sunday of the month following the month when the term of powers of the legislative (representative) body of state power of the legal subject of the Russian Federation expires.
In the event of dissolution of the legislative (representative) body of state power of a legal subject of the Russian Federation under circumstances and in the procedure stipulated by the Charter (Constitution) of the legal subject of the Russian Federation the head of the executive body of state power of the legal subject of the Russian Federation shall simultaneously set the election of deputies of the legislative (representative) body of state power of the legal subject of the Russian Federation of a new convocation. In this case election day shall be the last Sunday before the expiration of a three month period from the day of dissolution of the legislative (representative) body of state power of the legal subject of the Russian Federation. In this event the time terms for electoral activities set by this Law shall be reduced by a quarter.
Should the head of the executive body of state power of a legal subject of the Russian Federation having dissolved the legislative (representative) body of state power of the legal subject of the Russian Federation fails to set elections of deputies of the legislative (representative) body of state power of the legal subject of the Russian Federation of a new convocation the election of deputies of the legislative (representative) body of state power of the legal subject of the Russian Federation shall be held by the election commission of the legal subject of the Russian Federation on the first Sunday after the expiration of a three month term from the day of dissolution of the legislative (representative) body of state power of the legal subject of the Russian Federation.
Article 6. Foundations of Electoral System
In compliance with the Charter (Constitution) of a legal subject of the Russian Federation the legislative (representative) body of state power of the legal subject of the Russian Federation shall consist of ____ deputies.
Deputies shall be elected in single mandate territorial electoral districts on the basis of the standard representation quota for the electoral district. The standard representation quota in a single mandate territorial electoral district shall be set by dividing the total number of voters in the legal subject of the Russian Federation by ____ single mandate electoral districts.
Article 7. The Right to Nominate Candidates
The right to nominate candidates shall directly belong to voters and electoral associations, electoral blocs.
Article 8. Foundations of Participation of Electoral Associations, Electoral Blocs in Elections
An electoral association, electoral bloc may participate in elections of deputies on an equal basis in the procedure set by this Law.
If a public association is a member of an electoral bloc it may not act during elections as an independent electoral association or enter another electoral bloc. A decision concerning joining an electoral bloc shall be made at the congress (conference) of a public association, meeting of a regional branch of a public association; at the same congress (conference), meeting representative of the public association shall be appointed to the meeting for nomination of candidates from the electoral bloc. Electoral blocs shall be registered with the election commission of a legal subject of the Russian Federation. The registration shall be made not later than in 5 days after the submission, to the election commission of a legal subject of the Russian Federation, of the minutes of the congresses (conferences) of public associations or meetings of regional branches of public associations containing the decisions to enter the electoral bloc and the joint decision of the public associations concerning establishment of an electoral bloc signed by the authorized representatives of such public associations.
An electoral association, electoral bloc shall appoint representatives, authorized in compliance with this Law to represent the electoral association, electoral bloc in respect of all issues related to participation of the electoral association, electoral bloc in elections of deputies, including financial issues.
Article 9. Preparation and Administration of Elections by Election Commissions
Election commissions shall be in charge of preparation and administration of elections of deputies of the legislative (representative) body of state power of the legal subject of the Russian Federation and control over adherence to electoral rights of citizens.
Election commissions during the preparation and administration of elections shall, within the scope of their powers set by federal laws, laws and other statutory acts of the legislative (representative) body of state power of the legal subject of the Russian Federation be independent of the bodies of state power and bodies of local government.
Acts of election commissions adopted within the scope of their powers set by federal laws, laws and other statutory acts of the legislative (representative) body of state power of the legal subject of the Russian Federation shall be binding on bodies of state power, bodies of local government, public associations, enterprises, establishments, organizations and the officials as well as their subordinate election commissions.
Article 10. The Right to Election Campaigning
Citizens of the Russian Federation and public associations shall be entitled for free election campaigning guaranteed under this Law.
Citizens of the Russian Federation, public associations shall be entitled to perform activities encouraging voters to vote for or against any of the candidates in any lawful form and by legal methods.
Candidates for deputy, electoral associations, electoral blocs shall be provided a guaranteed access to state-owned mass media of the legal subject of the Russian Federation.
Article 11. Funding of Elections
Events related to preparation and administration of elections of deputies shall be funded at the expense of the budget of the legal subject of the Russian Federation.
Article 12. Publicity During Preparation and Administration of Elections
Preparation and administration of elections of deputies shall be open and public.
All decisions of election commissions, bodies of state power of the legal subject of the Russian Federation and bodies of local government related to preparation and administration of elections shall be subject to publication.
