Chapter 5. Electoral Commissions
Article 10. Types of Electoral Commissions
For organizing and holding Election to the Representative Bodies of the State Power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug the following Electoral Commissions shall be set up:
a) Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug for the Election to the respective Representative Bodies of the State Power. In the Oblasts, Autonomous Oblast, Autonomous 0krugs where under the Regulation for the Election to the State Duma one Constituency for the Election to the State Duma has been set up, the Okrug's Electoral Commission for the Election to the State Duma shall exercise powers of the Electoral Commission for the Election to the Representative Bodies of the State Power of the Oblasts.
b) the Okrug's Electoral Commissions for the Election to the Representative Bodies of the State Power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug;
c) District Electoral Commissions.
Article 11. Procedure for setting, up the Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblasts, Autonomous Okrug
1. The Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug shall be formed by the Chairman, Deputy Chairman, Secretary and 10-15 members of the Electoral Commission at least 70 days before the Election.
2. Members of the Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug shall be approved by the Central Electoral Commission under recommendation of the Body of the State power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug.
3. The Chairman and Secretary of the Electoral Commission should be graduates of the University Law-Faculties or should have the Degree on Laws.
Article 12. Procedure of setting up the Okrug's Electoral Commissions
1. The Okrug's Electoral Commission for the Election to the Representative Body of the State Power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug shall be formed in every Okrug accordingly by the Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug at least 55 days before the Election and shall consist of the Chairman, Deputy Chairman (Deputy Chairmen), Secretary and 5-10 members of the Electoral Commission.
2. The Chairman and Secretary should be graduated of the University Law-Faculties or should have the Degree on Laws,
3. Any Regional Electoral Association which nominated its Election Candidate for the present Constituency as well as any Candidate for the respective Constituency shall have the right to appoint one member of the Okrug's Electoral Commission with a right of the deliberative voice.
Article 15. Procedure of setting up the District Electoral Commissions
1. The District Electoral Commissions shall be formed by the Okrug's Electoral Commission at least 40 days before the Election and shall consist of the Chairman, Secretary and 5-10 members of the Electoral Commission.
2. Any Regional Electoral Association and any Candidate for the respective Constituency shall have the right to appoint one member of the respective Electoral Commission with the right of deliberative voice.
Article 14. Status of the Electoral Commission Member
1. Persons appointed to the Electoral Commissions by the higher Electoral Commissions shall have the right of a casting vote when decisions making by the Electoral Commissions and shall be bound to be present at any meeting of the Electoral Commissions.
2. Persons appointed to the Electoral Commissions by the Candidates and the Regional Electoral Associations, shall have the status of a member of the Electoral Commission with the right of deliberative voice.
3. Persons appointed to the Electoral Commissions with either a casting vote or a deliberative voice:
shall be notified in good time about meetings of the Electoral Commission and shall be present there;
shall have the right to make statements at the meeting of the Electoral Commission to make proposals on issues within' competence of the respective Electoral Commission and to demand to put them to vote;
shall have the right to question the other participants of the Electoral Commission's meeting on agenda and to get answers to the point;
shall have the right of access to any documents and materials of the respective Electoral Commission.
Article 15. Powers of the Central Electoral Commission
1. The Central Electoral Commission shall have the right to give in accordance with the Principal
Regulations explanations and methodical recommendations on holding the Election to the Representative Bodies of the State Power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug.
2. The Central Electoral Commission shall distribute resources allocated from the Republican Budget of the Russian Federation for financing support of the Election and shall control special-purpose use of these resources.
3. Shall exercise any other powers as stipulated by these Principal Regulations.
Article 16. Powers of the Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug.
1. The Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug;
a) shall give explanations based on recommendations and methodical instructions of the Central Electoral Commission and shall ensure a unified realization of these Principal Regulations and the Regulations for the Election to the respective Representative Bodies of the State Power;
b) shall supervise activities of the Okrug's Electoral Commissions;
c) shall consider applications and complaints about decisions and actions of the Okrug1 s Electoral Commissions and make decisions on them;
d) shall issue instructions and any acts on organizing the Elections issues in cases as stipulated by the present Principal Regulations;
e) shall provide observance of equal legal conditions of Pre-election activities for any of the Candidates;
f) shall carry out control of legality of holding the Election;
g) shall approve forms of the Ballot-papers, Registers of Voters, other election documents, procedure of their preserving, shall approve samples for stamps of the Electoral Commissions and ensure their manufacturing,
h) shall consider matters on technical-and-material support for arranging and holding Voting;
i) shall define voting results on the whole in the territory of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug, shall publish them in mass media, shall ensure transfer of the documents connected with the arranging and organization of the Election to an archive;
j) shall define persons elected to the Representative Bodies of the State Power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug and shall hand them certificates of election;
k) shall organize second Election to the Representative Bodies of the State Power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug;
l) shall exercise other powers as stipulated by the present Principal Regulations as well as by the Regulation for the Election to the Representative Bodies of the State Power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug.
2. Decisions of the Electoral Commissions of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug made within its competence shall be binding on the State Bodies, Public Associations, Enterprises, Institutions and officials obliged to assist the above Commission and to provide with any documents and information required for its activity.
3. Period for powers of the Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug shall be determined by the Representative Body of the State Power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug.
4. The Regulation for the Electoral Commission of the Krai, Oblast, Federal City, Atonomous Oblast, Autonomous Okrug shall be copied by the respective Representative body of the State Power or by the Head of the respective Administration in case of early termination of the powers of the above Body.
Article 17. Powers of the Okrug's Electoral Commission
1. The Okrug's Electoral Commission:
a. shall carry out control of performing the present Principal Regulations as well as the Regulations for the Election to the Representative Bodies of the State power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug in the respective territory;
b. shall supervise activities of the District Electoral Commissions, shall consider applications and complaints about decisions and actions of the above Electoral Commission and shall make decisions on the above;
c. shall register Candidates and their accredited representatives and shall hand them the approved certificates;
d. shall ensure observance of equal legal conditions of pre-election activities for every Candidate;
e. shall dispose of financial and material resources allocated for the Election Campaign;
f. shall define the Election results for the Constituency shall transfer the above information accordingly to the Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug, shall ensure transfer of documents connected with the Election Campaign,
g. shall approve the text of the Ballot-papers for voting, shall provide production of the Ballot-Papers and furnish the District Electoral Commissions with them;
h. shall control providing of the District Electoral Commissions with offices, transport, communications and shall consider other matters of technical-and-material support of the Election;
i. shall exercise other powers in accordance with the present Principal Regulations as well as the Regulation for the Election to the Representative Bodies'of the State power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug.
2. The Okrug's Electoral Commissions shall act until termination of the powers of the Electoral Commissions of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug.
Article 18. Powers of the District Electoral Commission
1. The District Electoral Commission:
a. shall organize drawing up the additional Register of Voters for the Electoral District;
b. shall introduce the Register of Voters to the Voters shall accept
c. and consider applications on mistakes and errors: in the Register of the Voters and shall make decisions on making the appropriate corrections in the above Register;
d. c)shall notify people on the Day of the Election and place of Voting;
e. shall control placing of the Pre-election propaganda material under procedure and quantities as stipulated by the present Principal Regulations;
f. shall ensure preparation of an office and equipment for Voting;
g. shall organize Voting at the Electoral District at the Election Day;
h. shall calculate votes, shall define results of Voting at the Electoral Districts and shall ensure transfer of the documents connected with holding and organizing the Election to an archive;
i. shall consider applications and complaints about the Election Campaign and organizing Voting and shall make decisions on the above;
j. shall exercise other powers as stipulated by the present Principal Regulations as well as the Regulation for the Election to the Representative Bodies of the State Power of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug.
2. Powers of the District Electoral Commission shall be terminated at the moment of the Electoral Documentation transfer by it.
Articie 19. Organization of the Electoral Commissions Activities
1. The Meeting of the Electoral Commission shall be competent if at least two thirds of members with casting vote for making decisions by the Electoral Commissions are present.
2. The Meetings of the Electoral Commission shall be convened, and held by the Chairman or under instruction of the above by the Deputy Chairman of the Electoral Commission. The Meetings shall be also held under request of at least one third of members of the Electoral Commission with the Casting vote or under request of at least half of all members of the above.
3. Decisions of the Electoral Commission shall be made by the majority of votes of members with the Casting vote present at the Meeting.
4. Instructions and other decisions of normative character of the Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug shall, be made by majority of votes of members of the Electoral Commission with the Casting vote and shall be subject to publishing.
5. The Chairman of the Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug, the Deputy Chairman and Secretary of the Electoral Commission shall operate for the Electoral Commission on the permanent basis. The Members with the Casting vote of the Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug may operate permanently or temporarily with giving up their main work.
6. Under the decisions of the Okrug's Electoral Commissions the Chairman (his Deputy Chairman), Secretary and some members with the Casting vote of the Okrug's and District Electoral Commissions may operate for the Electoral Commissions permanently or temporarily with giving up their main work.
7. Payment for work shall be made within the budget funds allocated for maintenance of the respective Electoral Commissions.
8. Budget of expenditures related to activities of the Electoral Commissions of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug shall be included into the Republican Budget of the Russian Federation in separate line.
9. The mass media representatives accredited to the Electoral Commissions of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug may be present at the Meetings of the above Commissions. The representatives of any mass media may be present at the Meetings of the District Electoral Commissions.
10. The Minutes of the Electoral Commission shall be signed by the Chairman of the respective Meeting and by the Secretary of the Commission.
11. All State Bodies, Organs of Local Self-Government as well as officials of the above shall be obliged to provide the Electoral Commissions with assistance required for the proper performance of their duties.
Article 20. Appeal against, decisions and actions of the Electoral Commissions
1. Decisions and actions of the Electoral Commission of the Krai, Oblast, Federal City, Autonomous Oblast, Autonomous Okrug may be appealed to the Krai's, Oblast's, City or the Okrug's Court under procedure as stipulated by the law.
2. Decisions and actions of the Okrug's and District Electoral Commissions may be appealed to the higher Electoral Commission or in the Court under the procedure as stipulated by the law. The preliminary appeal to the higher Electoral Commission shall be not obligatory condition for appeal to the Court.
