Chapter 8. Settlement of Complaints and Disputes

Article 38. Contesting the incorrectness in the registers of the voters

1. Any citizen of the Russian Federation who meets the requirement of paragraph 1 of Article 2 and doesn't fall under paragraph 3 of Article 2 of the present Principal Regulations shall have the right 'to make an application to the district election commission about any error or inaccuracy in the Register of the Voters. The district election commission within 24 hours shall be obliged to verify the application, and either to eliminate the error or to give the applicant a certificate about a reasonable rejection of his application.

2. Any actions and decisions of the election commission may be appealed against in court in accordance with the prescribed procedure.

Article 39. Contesting the refusal to register the Candidate

1. In case of a refusal to register a Candidate, the election commission shall be obliged to give him or his representative a certificate stating the reasons of the refusal. The sole reason for a refusal may only non-fulfillment of the requirements of the present Principle Regulations.

2. The Candidate may appeal in court against the refusal to register the Candidate, the reasons of such refusal end also against non-issuing of the certificate in accordance with the prescribed legal procedure.

Article 40. Contesting the boundaries of the constituencies.

1.Within five days after publication of the list of the single-candidate constituencies, the boundaries of the constituencies being formed in accordance with the present Principal regulations, as well as with appropriate Regulations on election to the representative bodies of the state power of the krai, oblast, federal city, autonomous oblast, autonomous okrug, may be contested. A complaint shall be made by Head of Administration or by the body of the local self-government of the affected territorial unit, which is the part of the respective krai, oblast, federal city, autonomous oblast, autonomous okrug, to the election commission of the krai, oblast, federal city autonomous oblast, autonomous okrug, and this commission shall examine the complaint and either shall correct the boundaries of the constituencies with publication of the revised scheme or shall give to the applicant a certificate with a reasonable refusal of the application.

2. The refusal of the complaint by the electoral commission or non-fulfillment by this commission of the responsibility stipulated in paragraph 1 of the present Article may be contested in conformity with the prescribed legal procedure.
